Responding to Unemployment Insurance Claim Notices

The Employment Development Department (EDD) and employers share information that helps determine if a person is eligible for Unemployment Insurance (UI) benefits. The EDD uses this information to decide if someone can get benefits. The information is collected through notices and forms that are time sensitive. These notices are the main way employers can provide eligibility information and manage their reserve accounts. Your input is vital, as it helps the EDD make accurate eligibility decisions.

Review the UI Claim Notices below to learn what each notice is for, and why it’s important to send them back to the EDD with the right information.

Notice of Unemployment Insurance Claim Filed (DE 1101CZ)

This notice is sent to the last employer when a claim for unemployment benefits is filed. It includes the reason the individual said they were no longer working. This is the first opportunity for employers to share their perspective by responding within 10 days of the date of the notice. Responding timely ensures:

  • A written decision from the EDD.
  • Employer’s rights to appeal the decision.

Notice of Determination/Ruling (DE 1080CZ)

This notice tells employers if the EDD has decided that the former employee can get UI benefits. It explains the reason for the decision, the part of the UI law that applies, any charges to the employer’s reserve account, and appeal rights. If you disagree with the decision, we encourage you to appeal, but you must do it within 30 days of the date on the notice. Remember, failure to respond to the Notice of Unemployment Insurance Claim Filed (DE 1101CZ) means:

  • Employer is not entitled to receiving a Notice of Determination/Ruling.
  • Employer cannot appeal the EDD’s decision.

Notice of Wages Used For Unemployment Insurance Claim (DE 1545)

This notice is sent to all base period employers, including the most recent one, after the first UI payment is made. It tells employers the percentage of benefits charged to their employer reserve account. This is the second opportunity for the last employer and the first opportunity for base period employers (those who were not the last employer) to provide eligibility information. You must respond in writing and mail the response within 15 days of the date on the notice if you disagree with the charges. Employers can ask for a ruling to remove charges from their reserve account. The EDD will decide if charges will be applied or not.

New Employee Registry (DE 1296NER)

This form is mailed to employers to gather information about a new employee who may also be collecting UI benefits. Giving the work start date helps stop overpayments and keeps your reserve account from being charged after the worker returns. Employers are required to respond within 10 days of the date on the notice.

Benefit Audit (DE 1296B)

This form is sent to employers when the EDD notices that an employee got UI benefits for a week they also earned wages. As part of the audit process, EDD asks for wage details for certain weeks that claimants may have worked. EDD then uses the information to identify claimants who may have improperly received benefits for those weeks. If workers didn’t report their earnings while getting benefits, they are liable for an overpayment. Employers are required to respond within 10 days of the date of the notice.

Request for Additional Information (DE 1326ER)

This form is sent to employers when the EDD needs to confirm the identity of a claimant. If the information is correct, the claimant no longer works for you, and there is no reason to suspect the information provided is fraudulent, then there is no need to respond. If there are errors or concerns about fraud, fill out the form and return it within 10 days of the notice date.
