Misconduct MC 350 - Reason for Decision

A. Off-the-Job Conduct (General)

You were discharged from your last job with (Employer Name) because of your off-the-job conduct. After considering the available information, the Department finds what you do not meet the legal requirements for payment of benefits.

B. Collecting Benefits While Working

You were discharged from your last job with (Employer Name) because you collected unemployment insurance benefits while working for the employer. After considering the available information, the Department finds that you do not meet the legal requirements for payment of benefits.

C. Traffic Violations - License Suspended

You were discharged from your last job with (Employer Name) because your driving license was suspended due to traffic violations. After considering the available information, the Department finds that you do not meet the legal requirements for payment of benefits.

NOTE: This reason for decision is also applicable if the violations occurred prior to the claimant's working for the discharging employer.

D. Wage Garnishment

You were discharged from your last job with (Employer Name) because of garnishments of your wages. After considering the available information, the Department finds that you do not meet the legal requirements for payment of benefits.

E. Loss of Transportation

You were discharged from your last job due to your loss of transportation. You are considered to be at fault as you had control over the reason for the loss. After considering the available information, the Department finds that you do not meet the legal requirements for payment of benefits.

AA. Off-the-Job Actions - No Adverse Effect - Not Based on Information Obtained From Work

You discharged the claimant for his or her off-duty actions. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.

BB. Exclusion From Employer's Liability Insurance - Claimant Still Allowed to Drive at Work

You discharged the claimant for being excluded from your motor vehicle liability insurance policy. After considering the available Information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.

CC. Pre-employment Activities

You discharged the claimant for his or her actions that occurred prior to the claimant being employed by you. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.

DD. Wage Garnishment

You discharged the claimant for incurring a wage garnishment. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.

EE. Loss of Transportation

You discharged the claimant for the loss of his/her transportation. This loss was beyond the claimants control. After considering available information, the Department finds that the reasons for discharge do not meet the definition of misconduct connected with work.

FF. Filing for Unemployment Insurance Benefits

You discharged the claimant for filing an unemployment insurance claim. The claimant was employed by you on a less than full-time basis and was legally entitled to file a claim for unemployment benefits. After considering available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.
