II. ELIGIBLE
AA. Discharge for Giving of Notice
You discharged the claimant primarily because he/she had given notice to be effective at a future date. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.
BB. Employer Unwilling to Give Any Information
You discharged the claimant but are unwilling to give any information to the Department concerning your reason(s) for doing so. In the absence of any information, the Department cannot find that the discharge was for misconduct in connection with the work.
CC. Failure to Discharge Promptly
You discharged the claimant on ( enter date ). Although the initial reason for discharge was potentially disqualifying, you did not discharge the claimant promptly. You delayed the discharge for reasons within your control. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with work.
DD. Disciplinary Suspension - No Misconduct
You suspended the claimant. After considering the available information, the Department finds the reason for suspension does not meet the definition of misconduct connected with the work.
EE. Retired Annuitant
You discharged the claimant in compliance with the terms of state law that prohibits state agencies or other public employers from employing annuitants who have collected unemployment compensation within 12 months of hire date. After considering the available information, the Department finds the reasons for discharge do not meet the definition of misconduct connected with the work.
