Professional Athlete Claims

I. DISQUALIFICATION

A. Professional Athlete - Reasonable Assurance

Your claim is based partly, or in full on wages you earned in professional sports. You have a reasonable assurance of returning to play in the coming season. After considering available information, the Department finds that you do not meet the legal requirements for payment of benefits.

II. ELIGIBLE

AA. Services Were Not as Athlete

(Enter Code Section 1253.4, issue ATH, and Reason for Decision MI70 AA.)

The claimant left your employ after the last sports season and is expected to return the next season. After considering available information, the Department finds that the type of services performed were other than athletic services. Under these circumstances, the Department finds that the claimant is eligible for benefits.

BB. Athletic Not Under Contract

(Enter Code Section 1253.4, issue ATH, and Reason for Decision MI70 BB.)

The claimant worked for you during the last sports season but has no contract for the next season. Available information shows that the claimant has no reasonable assurance of performing services during the next season, and may be eligible for benefits.

CC. Withdrawal From Professional Sports

(Enter Code Section 1253.4, issue ATH, and Reason for Decision MI70 CC.)

The claimant worked for you during the last sports season but has retired or withdrawn from professional sports since that time. Available information shows that he/she has no reasonable assurance of employment for the next sports season and may be eligible for benefits.
